These Terms of Service ("Terms") govern your access to and use of yumtuck.com (the "Site") and any purchase you make from YumTuck ("YumTuck," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your state or country of residence, to purchase from the Site. By placing an order you confirm that you meet this requirement and that the information you provide is accurate.
2. Products
YumTuck sells lunch boxes and food containers made from stainless steel and silicone. We work to display our products and their descriptions, colours, and details as accurately as possible, but we cannot guarantee that your screen accurately reflects the product — colours in particular may vary slightly between screens and between production batches. All products are subject to availability, and we may limit quantities or discontinue products or colourways at any time.
3. Safe use — important notice
Our products are food containers intended for everyday use by children and adults.
Do not place any YumTuck product in a microwave. The steel components are not microwave-safe. Do not use on a stovetop, in an oven, or over an open flame.
Steel conducts heat and cold. Take care when packing hot food, and allow contents to cool before handing the box to a young child.
Inspect the silicone seal and any removable parts before each use, and keep small removable parts away from children under three. Discontinue use if a component is cracked, deformed, or damaged. Follow the cleaning and care instructions supplied with your product.
4. Pricing and payment
All prices are listed in US dollars (USD). We strive for accuracy, but errors in pricing or product information may occur; we reserve the right to correct errors and to cancel any order placed at an incorrect price, even after the order has been confirmed. Payment is due at the time of purchase. You authorise us and our payment processors to charge your selected payment method for the total order amount, including taxes and shipping. Applicable sales tax is calculated and shown at checkout.
5. Orders
Your receipt of an order confirmation does not constitute our acceptance of an order. We reserve the right to refuse, limit, or cancel any order at our discretion — for example, in cases of suspected fraud, errors, or product unavailability. If we cancel an order you have paid for, we will refund you.
6. Promotional bundles and free items
Where a promotion includes a free or discounted item as part of a multi-item bundle, that item is supplied only as part of the qualifying bundle. If a bundle is returned or refunded in part, we may adjust the refund to reflect the value of any free item retained. Promotional pricing applies while the promotion is running and may be changed or withdrawn at any time.
7. Subscriptions
We do not currently offer subscriptions. If we introduce them, any subscription purchase will be governed by our Subscription & Cancellation Policy, which is incorporated into these Terms.
8. Shipping
Shipping timelines, rates, and coverage are described in our Shipping Policy, which is incorporated into these Terms. Title and risk of loss pass to you upon delivery to the carrier.
9. Returns, refunds, and our guarantee
Refunds, returns, and our Outlast Guarantee are governed by our Refund & Returns Policy, which is incorporated into these Terms.
10. Intellectual property
All content on the Site — including text, graphics, logos, images, photography, and the YumTuck name and branding — is owned by YumTuck or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our prior written permission.
11. Customer reviews and submissions
If you submit a review, photo, comment, or other content to us or the Site, you grant YumTuck a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt that content for marketing and operational purposes. You are responsible for the content you submit and confirm it is accurate, lawful, your own, and reflects your genuine experience.
12. Acceptable use
You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to attempt unauthorised access, or to use automated means to scrape or collect data without our permission.
13. Disclaimers
The Site and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure, or error-free.
14. Limitation of liability
To the fullest extent permitted by law, YumTuck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, arising from your use of the Site or products. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order.
15. Indemnification
You agree to indemnify and hold harmless YumTuck, and its officers, employees, and agents from any claims, losses, or expenses arising from your breach of these Terms or your misuse of the Site or products.
16. Governing law
These Terms are governed by the laws of Sweden without regard to conflict-of-law principles. You agree that any dispute will be subject to the exclusive jurisdiction of the courts located in Borås, Sweden, except where prohibited by applicable law.
17. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
